Kerala govt moves SC against CAA, first state to do so

New Delhi  (thestates.news) | The Kerala government on Tuesday moved the Supreme Court against the Citizenship Amendment Act (CAA), thereby becoming the first state to do so.
It also challenged the Passport Act and Foreigners Act Rules.
The plea has been filed under Article 131 of the Constitution which empowers the Top Court to hear disputes between Union government and one or more states.
It seeks that CAA should be declared violative of Articles 14, 21 and 25 of the Constitution and basic structure of secularism in India.
Article 14 promises Right to Equality to all while Article 21 says “No person shall be deprived of his life or personal liberty except according to a procedure established by law” and Article 25 says “all persons are equally entitled to freedom of conscience”.

The Centre, represented by Secretary, Ministry of Law and Justice is made the defendant in the suit.

At least 60 petitions challenging the validity of CAA are pending before the Apex Court and are likely to be heard on January 22.
On December 31, the Kerala Legislative Assembly had passed a resolution demanding scrapping of the CAA.
